Intellectual Property & DMCA Policy
Overview
This policy sets out how Bekby LLC, doing business as Arbasa ('we', 'us', 'our'), respects intellectual property rights, how rights holders can report infringement on arbasa.com, and how users can submit counter-notices. This policy is issued under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512 and applies to all content on our website.
1. Our Intellectual Property
All original content on arbasa.com — including our brand name 'Arbasa', logo, website design, layout, graphics, original text (including all policy documents), and custom software — is owned by Bekby LLC d/b/a Arbasa, or is licensed to us. This content is protected by US and international copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, display, or create derivative works from our original content without our prior written permission. For licensing or partnership enquiries, contact info@arbasa.com.
2. Third-Party Product Content
We are a dropshipping retailer. Product images, descriptions, and specifications displayed on our product pages are provided by our third-party suppliers. While we strive to use only authorised content, we acknowledge that in a dropshipping model, product images may be sourced from supplier catalogues. If you believe any product image or description on our site infringes your copyright or trademark, please use the notification procedure in Section 3.
We respect the intellectual property rights of all brands, designers, and photographers whose work appears on our platform, whether provided by suppliers or generated by us.
3. Reporting Copyright Infringement (DMCA Takedown Notice)
Arbasa has designated a DMCA Agent to receive notifications of claimed copyright infringement. To submit a valid DMCA takedown notice, your written notification must include all of the following six elements required by 17 U.S.C. § 512(c)(3):
- Identification of the copyrighted work: A description of the work you claim has been infringed, or if multiple works are covered by a single notification, a representative list.
- Identification of the infringing material: A description of the material you claim is infringing, and its location on our website (URL or sufficiently detailed description to allow us to locate it).
- Your contact information: Your address, telephone number, and email address.
- Good faith statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
- Accuracy statement: A statement that the information in the notification is accurate, and — under penalty of perjury — that you are authorised to act on behalf of the copyright owner.
- Physical or electronic signature: Your physical or electronic signature (or the signature of a person authorised to act on your behalf).

Incomplete notices will not be acted upon. We will acknowledge valid notices within 3 business days and take appropriate action (typically removal of the identified content) within 10 business days.
⚠️ Warning regarding false claims: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including legal fees. Please ensure your claim is valid before submitting.
4. Counter-Notification Procedure
If you are the owner of content that was removed following a DMCA notice and you believe the content was removed in error or misidentification, you may submit a counter-notification to our DMCA Agent. A valid counter-notification must include:
- Identification of the removed material: A description of the material that was removed and where it appeared on our website before removal.
- Statement under penalty of perjury: A statement that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your consent to US federal court jurisdiction: A statement consenting to the jurisdiction of the Federal District Court for the judicial district where your address is located, or if outside the US, for any judicial district in which Arbasa may be found.
- Your contact information: Your name, address, telephone number, and email.
- Your physical or electronic signature.
Send counter-notifications to: info@arbasa.com with subject line "DMCA Counter-Notification — [Your Name]".
Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the complainant does not notify us within 10–14 business days that they have filed a court action, we may restore the removed content.
5. Repeat Infringers
In accordance with the DMCA and our safe harbour obligations, Arbasa maintains a policy of terminating the accounts of users or suppliers who are determined to be repeat infringers of copyright in appropriate circumstances.
6. Trademark Policy
We respect the trademark rights of third parties. We do not knowingly sell counterfeit goods or use trademarks in a way that is likely to cause consumer confusion. If you believe your trademark is being infringed on our website, please contact us at info@arbasa.com with:
- The trademark(s) at issue and the registration number(s) if registered
- A description of the allegedly infringing use on our website and the relevant URL(s)
- Your contact information and a statement of your authority to act
We will investigate all trademark complaints and take appropriate action.
7. Dropshipping — Supplier IP Compliance
As a dropshipping retailer, we source products from third-party suppliers. We require our suppliers to represent that they have all necessary rights to the product images, descriptions, and branding they provide us. We do not knowingly list products that infringe on the intellectual property rights of third parties.
If you are a brand owner and you believe one of our suppliers is using your brand, designs, or imagery without authorisation, please contact us at info@arbasa.com and we will remove the product listing pending investigation.
8. User-Generated Content
If you post reviews, photos, or other content on our website, you grant Arbasa a non-exclusive, royalty-free, worldwide licence to use, reproduce, modify, and display that content in connection with our business. You represent that you own or have the right to grant this licence and that your content does not infringe any third-party rights.
