Warranty Disclaimer

Overview

This Warranty Disclaimer applies to all products sold by Bekby LLC d/b/a Arbasa ('we', 'us', 'our') through arbasa.com. It should be read alongside our Terms of Service, Refund & Returns Policy, and Product Safety & Compliance Statement, each of which is available on our website.

⚠️ IMPORTANT: Nothing in this Warranty Disclaimer limits or excludes any statutory rights you have under the consumer protection laws of your country. See the jurisdiction-specific sections below for details.

1. No Express Warranty (Unless Stated)

Unless a product page on our website explicitly states that a manufacturer's warranty is included with a specific product, Arbasa does not offer any express warranty on products sold through our store. Products are sold as described on the product page at the time of purchase.

Where a product page states that a manufacturer's warranty applies, the terms of that warranty are provided by the manufacturer or supplier — not by Arbasa. Arbasa acts only as the seller of record and is not responsible for honouring third-party manufacturer warranties. Warranty claims under a manufacturer's warranty must be directed to the manufacturer directly.

2. Disclaimer of Implied Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ARBASA DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION:

  • The implied warranty of merchantability (that a product is fit for the ordinary purposes for which such goods are used);
  • The implied warranty of fitness for a particular purpose (that a product is suitable for any specific purpose you intend);
  • Any implied warranty arising from course of dealing or course of performance.

This disclaimer applies to all products unless expressly overridden by a written warranty provided at the time of sale.

📝 Note on jurisdiction: Some jurisdictions — including all EU member states, the United Kingdom, Australia, Canada, and certain US states — do not allow the exclusion or limitation of implied warranties in consumer contracts. The disclaimers above do not apply where prohibited by law. Your statutory rights in those jurisdictions are set out in Section 4 below.

3. Magnuson-Moss Warranty Act (US Customers)

For US customers, the Magnuson-Moss Warranty Act (15 U.S.C. §§ 2301–2312) governs written warranties on consumer products. Where Arbasa provides a written warranty on a specific product, that warranty will comply with Magnuson-Moss requirements and will be available for review prior to purchase. Where no written warranty is provided, Arbasa is not required to comply with Magnuson-Moss disclosure requirements, though implied warranty disclaimers are subject to state law limitations.

In states including Maine, Vermont, and Massachusetts, implied warranties cannot be fully disclaimed on consumer goods. Residents of those states retain their full implied warranty rights regardless of this disclaimer.

4. Your Statutory Rights — by Jurisdiction

European Union & EEA — EU Consumer Sales Directive & Sale of Goods Directive

Under EU Directive 2019/771, you are entitled to a legal guarantee of conformity for goods for 2 years from delivery. If a product is not in conformity with the contract (not as described, not fit for purpose, or defective), you are entitled to repair, replacement, price reduction, or refund — in that order of remedies. Arbasa is responsible for any lack of conformity existing at the time of delivery. The burden of proof is on Arbasa for the first 12 months.

United Kingdom — Consumer Rights Act 2015

Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose, and as described. You have the right to a full refund within 30 days of purchase if goods do not meet these standards. After 30 days, you are entitled to one repair or replacement attempt; if that fails, you are entitled to a price reduction or final right to reject. These rights last for 6 years from purchase (5 years in Scotland). Arbasa bears the burden of proof for the first 6 months.

Australia — Australian Consumer Law (ACL)

Under the ACL, our goods come with guarantees that cannot be excluded. You are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure is not a major failure. These rights have no fixed time limit — they apply for a 'reasonable time' depending on the nature of the goods.

Canada

Provincial consumer protection legislation in provinces including Ontario (Consumer Protection Act, 2002), British Columbia (Sale of Goods Act), and Quebec (Consumer Protection Act / Civil Code of Quebec) provides statutory implied warranties of merchantability and fitness. These cannot be excluded for consumer transactions. Nothing in this disclaimer limits your rights under applicable provincial law.

5. How to Claim for a Defective Product

If you believe a product you received is defective or does not conform to its description, please:

  • Email info@arbasa.com with subject line "Defect Claim – [Order Number]" within 30 days of receiving the item (or within the applicable statutory period in your jurisdiction).
  • Include your order number, a description of the defect or non-conformity, and clear photographs.
  • We will respond within 2 business days with our proposed remedy: repair, replacement, or refund.
  • For EU/UK/Australian customers: if we propose a repair or replacement and it is not completed within a reasonable time or without significant inconvenience to you, you retain the right to a price reduction or full refund.

Statutory warranty and defect claims are handled under our Refund & Returns Policy (available at /pages/refund-policy) and are subject to any additional rights you have under the consumer laws of your country.

6. Limitation of Liability

Our liability for any warranty claim is limited to, at our option: (a) repair or replacement of the defective product; or (b) refund of the purchase price.
