Sales tax: Applicable sales tax will be charged based on your shipping address in accordance with state and local tax laws. Customers outside the US may be subject to import duties, customs fees, and local taxes, which are the buyer's sole responsibility.

5. Order Acceptance & Cancellation

Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order at our discretion, including due to: product unavailability, pricing errors, suspected fraud, or inability to verify your identity or payment. An order is accepted when you receive an order confirmation email from us. The contract of sale is formed at that point.

You may request to cancel an order before it has been shipped by emailing info@arbasa.com. Once an item has been shipped, our Refund & Returns Policy applies.

6. Shipping & Delivery

Estimated delivery times are provided as guidance only and are not guaranteed. Risk of loss and title for products pass to you upon our delivery to the shipping carrier. Please refer to our Shipping Policy for full details on shipping times, carriers, and international orders.

We are not responsible for delays caused by customs, carrier issues, natural disasters, or other events beyond our control.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict of law principles.

For US customers: Any dispute arising under these Terms that cannot be resolved informally shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA), conducted in New Jersey. Each party waives its right to a jury trial. You may opt out of arbitration within 30 days of first accepting these Terms by emailing info@arbasa.com with the subject 'Arbitration Opt-Out'.

Class action waiver: You agree that any dispute shall be resolved on an individual basis and not as a class or representative action.

For EU/UK/Australian customers: Nothing in this section limits your right to bring claims in the courts of your home country under applicable consumer protection law.

16. Force Majeure

We will not be liable for any delay or failure to perform our obligations under these Terms where such delay or failure arises from any cause beyond our reasonable control, including acts of God, pandemic, war, civil unrest, strikes, government action, or disruption to utilities, internet, or shipping networks.

17. Severability

These Terms, together with our Privacy Policy, Refund & Returns Policy, and Shipping Policy, constitute the entire agreement between you and Bekby LLC d/b/a Arbasa with respect to your use of our website and supersede all prior agreements and communications.
