Product Safety & Compliance Statement

Overview

Bekby LLC, doing business as Arbasa ('we', 'us', 'our'), is committed to offering products that are safe for consumers and compliant with applicable product safety regulations. This statement explains our approach to product safety, the regulatory frameworks that apply to our product categories, and how to report safety concerns.

As a dropshipping retailer, we source products from third-party suppliers. While we require our suppliers to comply with applicable safety standards and certifications, we acknowledge that we do not manufacture products ourselves. This statement reflects our compliance obligations and commitments as the seller of record.

1. Our Approach to Product Safety

  • We curate our product catalogue with safety in mind, prioritising suppliers who demonstrate compliance with relevant standards.
  • We require suppliers of regulated product categories (electronics, children's products, health/beauty devices) to provide evidence of applicable certifications before we list their products.
  • We display safety certifications on product pages where available and applicable.
  • We maintain a process for removing products from sale promptly when safety concerns are identified.
  • We cooperate fully with CPSC, FTC, and other regulatory authority inquiries and product recalls.

2. US Product Safety — Consumer Product Safety Commission (CPSC)

Products sold to US customers are subject to oversight by the US Consumer Product Safety Commission (CPSC). We comply with applicable CPSC requirements, including:

2.1 General products: All products sold by Arbasa are required to meet applicable federal consumer product safety standards under the Consumer Product Safety Act (15 U.S.C. § 2051 et seq.). Products are not designed, manufactured, or sold by Arbasa to be used in ways that create an unreasonable risk of injury or death.

2.2 Children's products: For products intended for use by children under 12: Must comply with the Consumer Product Safety Improvement Act (CPSIA) including lead content limits (< 100 ppm), phthalate restrictions, and flammability standards. Toys must meet ASTM F963 (Standard Consumer Safety Specification for Toy Safety). Must carry a Children's Product Certificate (CPC) from a CPSC-accredited third-party laboratory.

2.3 Cribs, infant products & juvenile furniture: We do not currently offer cribs, bassinets, or juvenile furniture subject to mandatory CPSC standards (16 C.F.R. Parts 1219–1220). Should we do so in future, full compliance will be required before listing.

3. Electronics — FCC Compliance

Electronic devices sold for use in the United States that intentionally or unintentionally emit radio frequency energy are subject to Federal Communications Commission (FCC) regulation under 47 C.F.R. Part 15.

We require FCC certification for all applicable electronic devices before listing. Relevant FCC IDs are displayed on product pages and product labels where required.

For products used internationally: FCC certification applies to US use only. Electronic products may require separate certification (CE marking, UKCA, etc.) for use in other markets.

4. EU Compliance

4.1 CE Marking: Products shipped to EU member states that fall within the scope of EU harmonisation legislation must bear CE marking. We require suppliers to provide CE Declaration of Conformity documentation for applicable product categories sold to EU customers.

4.2 EU General Product Safety Regulation (GPSR) — Regulation 2023/988: The EU GPSR (effective December 13, 2024) requires all consumer products sold in the EU to be safe, and a designated EU Responsible Person to be identified. Arbasa is establishing EU Responsible Person arrangements for our EU-destined product range. Contact us at info@arbasa.com for product-specific GPSR documentation.

4.3 REACH Regulation (EC No 1907/2006): Products sold in the EU must not contain Substances of Very High Concern (SVHCs) above threshold levels under REACH. We require our suppliers to confirm REACH compliance for applicable product categories.

4.4 RoHS Directive (2011/65/EU, amended 2015/863/EU): Electrical and electronic equipment sold in the EU must comply with RoHS restrictions on hazardous substances. We require RoHS compliance for applicable electronics.

5. United Kingdom — UKCA Marking

Following the UK's departure from the EU, products placed on the UK market may now require UKCA (UK Conformity Assessed) marking. During the current transition period, CE-marked products continue to be accepted in Great Britain in most categories. We will update our compliance requirements as UKCA transition deadlines are confirmed.

6. Australia — Product Safety

Products sold to Australian customers are subject to the Australian Consumer Law (ACL) product safety provisions and mandatory safety standards administered by the ACCC. We require our suppliers to confirm compliance with applicable Australian mandatory standards.

7. California Proposition 65

Products sold to California residents may be subject to the Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65). Where specific Prop 65 warnings are required for a product, they will be displayed on the product page.

8. Product Categories Not Sold by Arbasa

Arbasa does not sell, and has no plans to sell, the following regulated categories:

  • Prescription or over-the-counter medications or pharmaceutical products
  • Medical devices regulated by the FDA (except wellness/fitness devices where applicable)
  • Food, beverages, or dietary supplements
  • Firearms, ammunition, or firearm accessories
  • Regulated alcohol or tobacco products
  • Cannabis or cannabis-derived products

If a product listed on our website is incorrectly categorised as a medical device or food, please notify us immediately at info@arbasa.com.

9. Product Recalls

If a product sold by Arbasa is subject to a voluntary or mandatory recall, we will: immediately cease selling it; contact affected customers by email; provide return and refund instructions; and cooperate fully with the relevant regulatory authority.

10. Reporting a Safety Concern

Response time for safety reports: within 1 business day

Include: product name, order number, description of the concern, and photos if applicable.

You may also report product safety concerns directly to the CPSC at SaferProducts.gov (US) or the ACCC at productsafety.gov.au (Australia).
